If they did nothing an an old cartridge damaged your printer you would also be upset.

All a failed cartridge does is quit working. The exparation date is a CYA for HP to stop return of an old cartridge. I bought two cartridges at a time a few years ago when I had heavy use. The second one failed to work, and I got an exchange from the dealer.

I don't think the lawyers will have any problem collecting if they can prove the chip is set up to make the cartridge fail.
