I agree with the premise of your post but what you may not realize or, from your experience, have seen but not necessarily registered in your conscious, is that lawyers and the law are very slow to evolve. I know many lawyers who disdain anything new. I've seen senior partners rail against new phone systems, computers, innovative pleadings, etc., etc. This is not that much of a surprise where "precedent" is the basis of most decisions, throw in a little "policy" as a BS factor of course.

Vested interests and the sheer weight of a system forces it it move along at a snails pace. Most civil cases settle years after being started, with neither party better off, given the time value of money and the legal fees.

So, if it's evolution you want, I don't think you're going to find it in the court room. We need to revolutionize through other bodies of government, those who frame the settings and rules for our courts.
