Taser Says Lawsuit Alleging Injury During Demonstration Is Dismissed, Shares Rise

SCOTTSDALE, Ariz. (AP) -- Stun gun maker Taser International Inc. said Thursday that a lawsuit against the company was dismissed without prejudice.
Taser shares closed Wednesday at $13.50 on the Nasdaq, but rose $1.06, or 7.9 percent, to $14.56 in premarket activity.

In June 2004, Nick Kerchoff filed suit against the company in the District Court for the Eastern District of Michigan, alleging he was injured when he volunteered to experience a Taser discharge during a Taser device demonstration.

"We feel vindicated to have Taser International dismissed from this lawsuit," stated Doug Klint, vice president and general counsel of Taser. "There was no medical evidence linking the Taser device to Mr. Kerchoff's injuries. We will continue to aggressively defend this type of frivolous litigation."
