I doubt it. Sadly enough the state or their representatives hedge for such "damage" prior to letting the DNA checking procedures proceed. Unless the victim signs off all his rights for compensation they (threaten to) do their very best to prevent anything significant to happen until he is dead in jail and six feet well under.
