It actually is, more or less. They are the caretakers, and Jews are not allowed to go there. That's why Arafat was able to use Sharon's visit to the "Temple Mount" where the mosque is located as a catalyst for the second intifada.

Actually, biblical archeologists are up in arms with this arrangement, because the Palestinian caretakers have no regards for the relics and have been engaging in construction that the archeologists fear will result in the Mount collapsing. I wonder why the Israelis have never interfered.
