"Fallacy"? I would suggest that the "equal protection" argument is the basis of our republic.

re: As for gay marriage, I won't mind all that much if it gets legalized. But I certainly won't be voting for it, nor will I look too positively at judges who rule against the majority of the people based on a fallacious argument.

I agree with that. Why care about either issue? In the overall scheme of things, they mean nothing. How many people read those inscriptions, how many people care if a couple of gays are married or not. It's just partisan chatter by politicians that want to play emotional cards to get elected or reelected. It's cloud cover for the real issues.
