You know and I know that the Consitution doesn't discuss abortion or gay marriage or school busing.........after all it was written over 200 hundred years ago. What it does provide is a framework that can be applied to future events and situations like abortion or gay marriage etc.

It doesn't provide any framework that would allow the federal government the power to forbid the states from controlling these things. OTOH it doesn't provide the federal government the power to forbid the states from allowing them. The federal government wouldn't have to recognize and provide benefits to the marriages that the states allow but it can't prevent states from allowing same sex marriages without an amendment.

Its supposed to be the former but sometimes isn't. It isn't required to be the latter. If a strong enough majority disagrees with the constitution then it can be amended. The USSC isn't supposed to take a poll and then make its decision.
