This seems fine to me. But you'd also need a federal civil union law, right, because their are federal laws (primarily relating to taxes) about marriage as well.

You would if you assume that it is something that the feds should do, or have an obligation to do. If its just a matter of letting the states decide for themselves than presumably the federal government would decide for itself if there would be a federal civil union law or not.
