Not entirely. I believe there's a 2nd clause that says "We reserve the right to ignore the above or any other clause of the TOU at our discretion, and also to add anything at whim. Don't like it? Improve your psychic skills so you know what we will do in advance."

I move to strike the above from all consideration going forward in time.
