The courts are part of the government. You can argue that they are the right part of the government, and the other branches should butt out, but you really shouldn't say that you "don't want the decision to be made by the government" if you want it to be made by the courts.

Edit - Just to make my opinion clear I don't see this as something for the US congress or the president to get involved in.
