If people who are strict constitutionalists argued that congress or the president should get heavily involved then it would be hypocrisy but I don't think most Republicans are really strict constitutionalists. How many republicans are calling for eliminating a large array of popular government programs for constitutional reasons? When was the last time you heard Republicans (or Democrats for that matter) argue against a new social program because it constitutional basis was unclear or unsound?

Also I think this goes beyond pointing out hypocrisy. Its more an example of "whatever method might work so that I win this case", and itself is at least as hypocritical as the Republican's actions.
