If he said that Terri told him she would not want to live in a vegetative state, then that is fact. You can try to prove he is lying, and in that way, invalidate the fact but as it stands, it is fact. And it carries more weight because he is her legal guardian. Its the goal of the court to use what is called untainted evidence. And it is the court's purview to determine what is and what is not untainted evidence. Its why they work so hard to form juries. God knows that if you were accused of a crime and you were Jewish, the last person you'd want on the jury is Emile Vindrine. In the same way, the court has ruled that some testimony submitted as evidence is tainted and biased. An example is the affidavit from Nurse Sauer......she was the only one besides the Schindler family to make some of the accusations she makes.
