Yes, the law does not consider food, water and access to medical care "gray area" decisions. But even medical care sometimes falls into the "gray area" if it violates religious doctrine, as in the case of Christian Scientists.

Have you reconsidered your distinction between the right to food and the right to air? As I recall, that discussion was left hanging.
