Yeah, but there's an equitable principle at stake called "estoppel." You aren't allowed to take conflicting positions in successive lawsuits. Makes a mockery of the judicial system.

Not that I don't feel that the judicial system is making a mockery of itself in this case.

Not even one stinking dissent from Scalia. So much for him.
