I've already given examples of court decisions that don't follow the constitution.

If you mean Roe vs Wade, then you have not. The basis for Roe vs Wade is firmly rooted in the Constitution.

As for higher courts refusing to hear an appeal or agreeing with the original decision that happens all the time.

They don't when they think the lower courts have come to the correct ruling.
