If being ably qualified is the only qualification, none of the President's nominees should have had a problem.

Well, each of the candidates was very qualified, remember the American Bar Association even signed off on them. The problem is a minority of the Senators have decided that the only true qualification is that they NOT be strict Constitutionalists and in particular they must pass the test as being pro abortion. Whereas the Bush administration wants strict Constitutionalists who will follow the law and not attempt to MAKE the law. Using a provision not found anywhere in the Constitution and never used before in the advice and consent phase for selecting judges they have held up some very fine potential Appealate court judges and can be expected to be even worse for a Supreme Court nominee. jdn
