They just claim that they will talk. Under the new senate rules that's all it takes to have a filibuster. Isn't it ironic that if judicial filibusters are stopped, we'll end up with more debate, not less.

I'm not sure, but I think they say it is a filibuster and then they leave...You'll have to ask someone more knowledgeable about it than I am.
