When the constitution was written it was a very different time than now. The idea of separation of church and state, for example, had a very limited application and was mostly regarding high level govenment conduct. Now we have government funding in almost every aspect of individual human conduct. So the aspects of our daily lives that are under public domain is everywhere, except our private homes and designated places of worship.

Once the surveillance technology you speak of is in place will I be forbidden from prayer while driving down the interstate? I doubt it but the applicability of some inalienable rights is looking a little tweaked these days.
