It's the sheer arbitrariness of the courts that concerns me. Course only the priesthood of the bar can possible appreciate what they are doing at any given time. But show me two judges that can agree what any law means.

What if, say, the legislature decided to pass a law abridging the freedom of speech, or of the press. Should the courts defer? Yes, they did.

I'm glad you mentioned it.....I had forgotten. I just remember being appalled that a women might end up in jail for making this very difficult choice and I couldn't support that position. I've thought longer and harder and hope that somehow we'll find a better solution than the death and destruction that is inherent in abortion.

With his article, Brooks has written one of the most astute pieces I've ever read, and succinctly describes the consequences of a judgement made in haste.
