Activism is when the plain language is not followed. For example, find the words privacy or abortion in the Constitution or bill of rights. The words are not there. Since the words are not there, they are suppossed to be matters for the States OR better yet a Constitutional Amendment adding them. Judges have no business making Constitutional Amendments themselves. There is a good reason why the framers made it very difficult to amend the Constitution. It should be obvious that the framers thus never intended judges to make Constitutional Amendments on their own. Now we have justices basing decisions on things other than the Constitution, which they are forbidden to do.

I would say that is someone willing to create law, rather then just interpret and apply it.
