"Whereas by order dated March 28, 2005, this court required the defendant to submit an affidavit attesting to the authorship of defendant's motion to dismiss with prejudice plaintiff's amended complaint pursuant to rule 12 (b); and whereas this court received the defendant's affidavit pursuant to the court's order on April 14, 2005; it is hereby ordered that plaintiff's motion to strike defendant's motion to dismiss is denied; and it is further ordered that defendant's reply, if any, to plaintiff's opposition to defendant's motion to dismiss be filed by May 15, 2005."
