I agree with you on principal Brian. It seems very unfair. What's he going to do next, test people for alcohol use and fire them if they test positive? No more glasses of wine at dinnertime?

I agree, there are many examples of dangerous personal habits and hobbies, like extreme sports, that could wreck a company's health insurance. How about no more skiing?

It is a slippery slope for sure. I just wonder if the employees have any legal recourse in this business oriented society? I doubt they would win in court. In fact, I think this issue of firing cigarrette smoking employees has already come up in the past (this isn't the first time I've heard of this) and the courts decided on the side of the employer. In most states employees are "at will" employees, meaning they can be fired for just about any reason. I do find it especially troubling, since cigarrette smoking is a legal activity. But, employers set the rules for their "at will" employees, if they don't comply, they can be fired.
