If the employee is going to win, it will be on "right to privacy". But, the courts have to weigh a lot of competing rights and laws in these complicated cases. The employer's right to set work rules might be considered more important by the courts than an individual's "right to privacy". This not the first time these two rights have collided and usually the employer wins as a workplace is generally a private place and they set the terms of employment.
