You are a rancher in ND and now you can go to jail for raising your beef the "wrong" way? It's an interesting idea. They're trying to brand their beef like Idaho brands potatoes. In order to brand their beef, they have to have statewide compliance and conspicuous enforcement. It can't work otherwise. It seems to me that the problem you raise depends on how much support the plan has. If the state beef producers are virtually all on board, then it's a great idea. If it's something that a minority with clout came up with against the objections of some beef producers, then I agree with your concern.
