Actually, the military tries, or at least used to try, to work around the restrictions that Congress puts on it with regard to this issue. Because the implications of it are wide reaching. If there is a conflict going on, the fastest way to get promoted involves service in a combat area. If women can't serve in such an area, they get promoted at a much lower rate than men. Whatever else you might say about the military, they do tend to be sensitive to issues of unfairness in promotion.
