this is incredibly off the mark, overbroad and simplistic

The entire 20th century history of the US Supreme Court bears this out.

From whence derives the Constitutional right to privacy? How did it morph into the Constitutional right to use contraceptives? How did that morph into the Constitutional right to have a late third trimester, so called "partial birth" abortion, even when Congress outlawed it? How did it morph into the right to engage in homosexual sodomy?

None of these were put in place by the people of the United States nor their elected representatives.

These are the most controversial but there are plenty more.

If I am wrong, why are liberals fighting so hard to keep Bush's nominees from the bench?

What will you say if he re-nominates Bork? Who just got an award from the Justice Department.

How can a man (or woman) who graduated four years of college and three years of law school and passed a bar exam be considered anything but intelligentsia? Even in Louisiana.

How can any Justice who votes for the Constitutional "right" to engage in homosexual sodomy be considered conservative? Even if appointed by a Republican president.

Personally, I favor the elite imposing their views on the Great Unwashed, at times, e.g., I favor teaching evolution, which is an elite belief, rather than creationism, which is the belief of the masses. Google that if you don't believe me, the percentage of Americans who believe in literal creationism is astonishing.
