The change which precluded MLS members from using "pocket listings" not listed in the MLS went into effect around 1998 I think. Most of these changes are adopted by each MLS on the recommendation of the NAR.

Similar to the new requirement brought up two years ago that was going to preclude other broker's listing on your website on the internet without that Broker's permission. Originally it was just going to require that the listing also show the name and contact information of the Listing Broker. Then it became more restrictive - and the Justice Department talked about suing a few weeks ago.
