I think I agree with you but I was talking about 20th century judicial activism. I'm not sure how slavery relates unless your responding to the idea that some people use the existance of, and legality of, slavery in the early United States as an argument for judicial activism and you are trying to make an argument against them. If so I agree with your argument.
