That exception wasn't an exception because it wasn't a new judicial appointment but rather for a promotion to chief justice from associate justice.

Official rules are one thing. 'Tradition' is another.

'Tradition' does not have the force of authority.

You should be clear on the difference... you can gripe all you want to about 'tradition', but the rules are the rules.

If you don't like 'em, then change 'em.

The rules of the Senate say cloture requires a 2/3 majority vote to shut off debate.

The rules of the Senate also say that it requires a 3/5 majority vote to CHANGE THE RULES OF THE SENATE.
