UW, Can't fault the trial counsels (prosecutors)...I was one regularly, as well as defense counsel, as were all lieutenants in the old Corps before there was more than one lawyer/SJA in the Marine division. As you know, the convening authority (CO/CG) is the one that signs the referral to trial. Must have been a lot of external pressure when then-MGen "It's a hell of a lot of fun to shoot them." Mattis, CG, 1stMarDiv convened Article 32 investigations which resulted in referrals to trial for such. Looks like nonsense from 20-20 hindsight, but when you have the likes of NYT, ABC, and NewsWeak cameras and "reporters" sending back every "spit on the sidewalk" or "kick a public horse in the belly" Article 134 offense, yes, it is nice the see the UCMJ still works as advertised....jj kimdutoit.com
