I don't know either. But frankly, in a war, if you are on the other side, then I'd just assume you get detained until you are determined to be no longer a threat. According to Pentagon briefings, most of these Gitmo detainees were rounded up after direct hostile conflict with U.S. soldiers. You won't find many women or old men in that camp. They are usually young and angry. Many have stated they would continue fighting the U.S. if released. These are bad actors. So my sympathy is very limited for them.
