Is that a legal principle (or should it be) of international or national law?

What I mean is: If it were a valid legal principle... would it apply across the board?

For example: if Saddam had warned Kuwaiti (& all other nationality) civilians to get out of the way of his armies before he invaded Kuwait... would that mean that he couldn't be tried now for any 'inadvertant' deaths of civilians that happened during that war?

Just asking... it seems interesting.
