Sure it does. You don't know that your fungible product is confined to a state. If some of a fungible product is interstate, all of it is.

I think that they can use the rationale they used within the context that they used it. They just had the wrong context. This reminds me of the Bush/Gore case. They had an objective and they set aside contrary instincts and found a plausible rationalization to get there.
