Yes there have been, but much more infrequently then State prosecutions.

The case before the Supreme court was one such --- where the defendants had committed no crime at all according to the State (they were licensed by the State, in fact), but were prosecuted by the Feds.

In this case (terrible decision, IMO...) only Thomas, Reinquist & O'Conner got it right.

And Scalia signed up with the pro-big government Authoritarian 'liberals'.
