No communications means just that...consulting with lawyers is communications. The 4th convention article 5 which addresses unlawful combatants says that SUSPECTED combatants (doesn't say anything about a hearing) can be held for a military tribunal sometime in the future. There are no requirements for the military tribunal to be held quickly. The SUSPECTED status can come from anywhere and most likely from the troops that initially picked the individual up. Those troops or rear echelon troops taking possession of such individuals make the suspected classification and thats the end of it. Is this best system. I don't know. Perhaps there should be a fifth convention, but according to current rules, they can be held a very long time before a military tribunal.
