There are all sorts of questions that aren't being answered, including your list. There's also the question of just what was in the report. I think that an incident witnessed by an FBI agent and documented in an official FBI report is about as close to truth as you can find these days. But we don't know whether what was reported about the report is true. But clearly putting energy into eliciting an apology from Durbin for his "libel" is of greater value than any of those questions... :/
