adding that the prisoners are stateless fighters who are not explicitly governed by the conventions. This is what needs to be clearly articulated so that the variances from the treatment specified in the convention can be explained. This fence sitting is problematic. For example, prisoners are supposed to be returned to their homeland when the war is over. When will the war on terrorism be over? Perhaps not in the lifetime of these prisoners. So, if we're having issues over Gitmo now, what will be the pressure be after we've confined them for ten or twenty years? I think a case can be made for what's going on, but they've been ducking making it. Such temporizing is problematic.
