This ambivalent mish-mash will end badly.

Maybe not, but certainly the rationale hasn't been made well enough yet. It could be made in the future.

To date, though, the administration seems to be losing almost every judicial decision that I am aware of, but the Justice Department lawyers are masters at the game of hardball. They don't give up, even when they're losing. They take it to the limit.

Given Gonzalez' involvement in this so far, if he's nominated to replace Rehnquist, I predict things will get ugly fast. In fact, Durbin's comments could be the warm-up.

Rehnquist is likely to retire, time to get the public's attention in advance.

Could make the Bork nomination look like patty-cake.
