I wasn't thinking about who would get the Chief Justice slot, just that Rehnquist leaving would make 8 and they need 9.

Why Gonzalez? It's just scuttlebutt.

Also interesting timing. Rehnquist seems to be on the way out, and the Dems are beating the drums about Guantanamo. The memo in question (or report or whatever you want to call it) was written years ago (I don't know the exact date but obviously the events took place quite a while ago) and was released to public display in December, 2004.

Why is it newsworthy now? Because Gonzalez wrote the policy on treatment of prisoners in Guantanamo? Could be . . . .
