Hamdi is an American. What does that have to do with what we're talking about?

You continue to focus on outliers. You don't develop a system around the exceptions. You develop the system around the mainstream and then adjust it as necessary for the odd cases.

But CB, Hamdi only applies to the "narrow circumstances alleged in this case", ie a US citizen detained on US soil. And even then, the Supremes said that rules of evidence and procedure could be significantly relaxed to accommodate government interest in secrecy and conduct of war.

They were quite plain in saying Hamdi only applied to US citizens, held in the US.
