I agree. I think the question that should be asked is "do POWs get access to the domestic courts?" No, as a matter of fact they are immune from the courts under Geneva, IIRC. The POWs tried at Nuremburg were charged with war crimes. Once they were charged, they got due process. IIRC, the Geneva conventions provide a simple military hearing for status challenges, and that's it. I can understand CB's concern if we didn't give the detainees even this, but we have, and that's more than they are due IMO.
