The point is they DIDN'T SAY SO. They simply took it as a given - as an understood power of the states. The 5th amendment merely required that when the states exercised that already existing power, they must justly compensate for the property taken. I don't know how many more ways of saying that I'll have to come up with before you get my point.

As for Dred Scott, give me a freakin break. First we're about to lose our right to free speech and now you bring up slavery? Talk about red herrings.
