earnings (CPG) guidance? or analyst numbers that include flash? Again, as others have also said, if that were the case, you'd announce it WITH or just after poor earnings.

We have the first gut instinct of a few of us (on this board and others) that the timing of this law suit indicates that AMD expects 2Q 05 results to be poor.

But another thesis arises from the CC. That the company is doing well - servers spectacularly well - thereby undermining any potential accusation that AMD is trying to achieve in the courts what it cannot in the market.

But was the CC telegraphing (in the quiet period) good 2Q results or was it referring to the company's general prospects now as opposed to two years or more ago?

I got the impression that the Japanese decision against Intel and progress on the EU investigation was probably more influential on the timing of the law suit than this quarter's results - good or bad.

If the complaint timing was at all motivated by missed earnings, then surely they would have filed it 3 months ago, even if wasn't quite complete, no?
