I'm certain the Dem strategy was to stop their previous fillibusters so that they can conserve ALL their ammunition for the high court battle or battles. That is what is really happening. The Republicans need to repeatedly portray the Dems as obstructionists. I think appointing US Senators to the court would also help deflect the Dem strategy or portraying anybody and everbody as "extremists".
