This isn't just an artifact of Supreme Court nominations. Most conservatives take the outlandish positions they do because they somehow think that they will be punished for any independant thought. Once the pressure is removed by tenure or lifetime appointment they turn out to be positively human.

No matter who Bush nominates to the SC, they will be smeared, just as O'Conner was when she was nominated.
