What a lot of people forget is that most appeal judges, unless they are scathingly brilliant like Scalia, are only as brilliant as their law clerks. The higher a judge goes up the food chain, the more brilliant the law clerks. These are the folks who do the bulk of the opinion drafting and the legal research.

I think Garza has probably had some hellacious law clerks because the time I ran into him he seemed not too quick or prepared. Oh, he threw me a softball or two I hit hard on, then went along with the others in an unpublished opinion they were probably too embarrassed to make public.

I had the sense that Garza might be a hell of a pol, though.
