"And, at what cost to the rest of the president's legislative agenda?"

Depends on how immature the dems are. None of his legislative agenda can hold a candle to fixing the USSC. Not even close imo. You can have SS and any other of his issues. The dems can be responsible for it going BK and we'll see how that effects them. I think it will be fantastic for our nation to have judges that actually believe in our constitution, and will apply the correct standard for interpreting cases that are brought to them. Which is whether or not they are CONSTITUTIONAL. In the cases where the constitution needs to be changed, lets actually use the method the founding fathers laid out.

If you want my prediction, the dems will be VERY IMMATURE. Particularly the idiots like Kennedy and Leahy. They don't like our constitution, and I think the time is coming to an end where they get their way by judicial activism when the public is not behind them.

"at what cost to the Party in the mid-terms if two candidates perceives as 'hard-right' are elevated?"

The President was given a mandate to appoint conservatives to the courts. If he did not use his mandate the cost to the part would be large. DemoLibs are mobilized in the constant state of ABB frenzy. If he pisses of his base, the ABBs will win. President Bush must appoint honest constructionists to the courts, including the Supreme Court.
