I understand the difference, but in my example, you would be accused of torture (and not accused of removing an active threat).

The only thing you've qualified is that you favor torture in certain circumstances, and don't favor it in others. Same position that I have.

One problem...

You seem to think of things as black and white...you somehow KNOW the guy is blocking your access to your buried daughter.

How black and white is the real world?

What happens after you apply the thumbscrews and find out the person was involved, but didn't know where your daughter was buried...

The press and liberals will tear you up for the act...

In either case, I have no intention to cause pain and suffering to someone who has surrendered his fight against me and is posing no threat.

It is highly questionable that the "detainees" at Gitmo have surrendered their fight against us.

Due to their incarceration, they pose a lesser threat, but I wouldn't say they pose no threat.
