People can disagree about just about anything. That doesn't mean that one or more of them are not wrong.

I gave you a simple quick answer. Apparently you need a more detailed answer.

I am fairly certain that there are and have been a number of supreme court judges that strike down laws that they believe conform to the text of the constitution. These judges don't see the constitution as being actually limited to the constitution itself. They believe in a "living constitution" that changes over time even without amendments.
