My only point is that it seems unlikely that the DOJ would have bothered with the referral from the CIA if she was clearly outside the ambit of the statute. Thus, the tea leaves point in the direction of a finding that the statute applies to her.

Nonetheless, anyone who is eventually prosecuted will definitely attack the applicability of the statute to Plame and may very well succeed in doing so. On the presently known facts, I'd guess that this line of defense is unlikely to pan out. But it might.
